# Terms of Service — Leadspanic **Operated by Launch Logic Analytics LLC** **Effective Date: August 4, 2026** Please read these Terms of Service ("Terms") carefully before using https://leadspanic.com (the "Site") and the Leadspanic application (the "Service"), operated by Launch Logic Analytics LLC ("Leadspanic", "the Company", "us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by them. If you disagree with any part, do not use the Service. ## The Service and What It Is Not Leadspanic provides geodemographic market analysis, audience personas, area scoring, and marketing planning derived from aggregate U.S. Census and related public data, together with related advisory and done-with-you engagements ("Engagements"). **The analysis is statistical and area-level.** Personas, scores, and recommendations describe the aggregate character of Census tracts — statistical areas typically containing 1,200 to 8,000 residents. They are **not** predictions about, or profiles of, any identifiable individual, household, or address. **No guarantee of results.** Marketing outcomes depend on your offer, pricing, operations, creative execution, market conditions, ad-platform behavior, and factors outside our control. Nothing in the Service, in any Engagement, in any campaign plan, or in any statement by us is a guarantee, warranty, or promise of leads, revenue, return on ad spend, or any other business result. Any messaging guidance the Service produces is a **hypothesis to be tested**, not a statement of fact. **Not professional advice.** The Service does not provide legal, financial, tax, real-estate, lending, insurance, employment, or investment advice. **Your compliance obligations.** You are solely responsible for ensuring your advertising complies with all applicable law and platform policy, including any special-category or anti-discrimination requirements that apply to housing, employment, credit, insurance, or other regulated advertising. You must not use the Service, or any output of it, to target or exclude audiences on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected characteristic. We provide tools; you remain the advertiser. ## Accounts Sign-in is passwordless: we email a single-use link to the address you provide. You are responsible for maintaining control of that email account and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You must provide accurate information and be at least 18 years old and able to form a binding contract. ## Payment and Refunds **Fees and payment.** Fees for any Engagement, subscription, product, or digital deliverable are due as set out in the applicable order form, statement of work, checkout page, subscription plan, or invoice. Unless a separate written agreement signed by the Company expressly states otherwise, **all payments are final and non-refundable**, in whole and in part, and all deposits, retainers, milestone payments, subscription fees, and prepaid amounts are non-refundable. **Project Materials.** "Project Materials" means any deliverable, analysis, report, territory audit, persona profile, campaign plan, creative or messaging guidance, data export, workbook, process documentation, onboarding packet, recording, template, or other material we make available to you, in any form, whether delivered in a session, by file, by link, or through the Service. **No refunds after delivery.** **No refund of any kind will be issued, and all sales are final, once any Project Materials have been delivered, transmitted, downloaded, displayed, made accessible to, disclosed to, or otherwise distributed to you or anyone acting on your behalf.** This applies in full and without exception regardless of whether you have opened, reviewed, used, deployed, completed, or derived value from the Project Materials, and **regardless of the quantity of Project Materials delivered relative to the total scope**. Delivery of any portion of the Project Materials — for example a single territory audit, an onboarding packet, one persona profile, or one campaign plan — is deemed delivery for the purposes of this Section. **Partial performance.** Where an Engagement is delivered in stages, sessions, or milestones, **each stage delivered is a separate and complete delivery** for the purposes of this Section. Commencement of performance on any stage constitutes delivery of that stage. You acknowledge that the Company's work is front-loaded — the analysis, territory research, and strategic planning that underpin an Engagement are performed early and are irreversibly disclosed on delivery — and that partial completion therefore does not correspond proportionally to partial value received or to any pro-rata refund entitlement. **Cancellation and change of mind.** Your decision to cancel, withdraw, discontinue, stop participating, change your mind, dispute the value received, become dissatisfied, fail to use what was provided, fail to implement, or become unable to proceed for any reason **does not entitle you to any refund, credit, or chargeback** once Project Materials have been delivered as described above. You remain responsible for the full contracted or purchased amount. **Express consent to immediate performance; waiver of cancellation period.** By purchasing or engaging the Company, you expressly request and consent to the Company beginning performance and delivering Project Materials immediately, and you acknowledge and agree that, to the fullest extent permitted by applicable law, you **waive any cooling-off period, cancellation window, or right of withdrawal** that might otherwise apply once delivery of Project Materials has begun. **Pre-delivery refunds.** Where no Project Materials have yet been delivered, any refund is at the Company's sole discretion and, if granted, may be reduced by amounts reflecting time and work already performed, the value of any consultation or planning already provided, and any third-party, payment-processing, or non-recoverable costs already incurred. **Chargebacks.** You agree to contact us to resolve any billing concern before initiating a chargeback. Initiating a chargeback in breach of these Terms is a material breach, and we may suspend or terminate your access and recover the disputed amount and any associated costs. **Acknowledgment.** You acknowledge that the Company's pricing reflects this refund policy, that this policy is a material term of your purchase, that it is reasonable in light of the irreversible disclosure of proprietary intellectual property, methodology, and trade secrets involved in delivery, and that you have had the opportunity to review these Terms before purchasing. ## Term and Termination We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. On termination your right to use the Service ceases immediately. Termination does not entitle you to any refund except as expressly provided above. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. ## Content, Copyrights, and Trademarks The Service, the Site, and all Project Materials — including the persona taxonomy, messaging frameworks, scoring methodology, software, text, graphics, and design — are the property of Launch Logic Analytics LLC or its licensors and are protected by copyright, trademark, and trade-secret law. **Your license.** Subject to payment and these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use Project Materials **for your own business**. You may not resell, sublicense, republish, redistribute, or make Project Materials available to any third party, and you may not use them to build or train a competing product or dataset. **Third-party data.** Portions of the Service incorporate data from the U.S. Census Bureau and other public and licensed sources, subject to their own terms. Licensed third-party segmentation data may not be extracted, redistributed, or sublicensed. **Your data.** You retain ownership of data you upload. You grant us a license to process it solely to provide the Service to you. ## Prohibited Use of the Site You may not: use the Service unlawfully or in breach of any platform policy; scrape, harvest, or bulk-extract data from the Service; reverse-engineer or attempt to derive our methodology or underlying datasets; probe, scan, or test the vulnerability of our systems or breach any security or authentication measure; use the Service to build a competing product; impersonate any person or entity; or transmit malware or otherwise interfere with the Service. ## Privacy Your use of the Service is also governed by our [Privacy Policy](/legal/privacy-policy.md), which is incorporated into these Terms by reference. ## Accessibility We aim to make Leadspanic usable by as many people as possible and work toward conformance with WCAG 2.1 Level AA. If you encounter a barrier that prevents you from using any part of the Service, email cedric@obsidianaxisgroup.com and we will work with you to provide the information or functionality through an alternative means. ## Links to Other Sites The Service may contain links to third-party sites we do not control. We are not responsible for their content, privacy policies, or practices. ## Changes to These Terms We may modify these Terms at any time. Where a change is material we will provide notice through the Service or by email. Continued use after changes take effect constitutes acceptance. ## Disclaimer; Limitations of Liability THE SERVICE AND ALL PROJECT MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COURSE OF PERFORMANCE. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data, analysis, or recommendation is accurate, complete, or suitable for your purpose. TO THE FULLEST EXTENT PERMITTED BY LAW, LAUNCH LOGIC ANALYTICS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. **IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.** The above applies to any damages, liability, or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence, or any other cause of action. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. ## Indemnification You agree to defend, indemnify, and hold harmless Launch Logic Analytics LLC and its officers, members, employees, and agents from any claim, damage, obligation, loss, liability, cost, or expense (including legal fees) arising from your use of the Service, your breach of these Terms, your advertising or marketing activity, or your violation of any law or third-party right. ## Miscellaneous These Terms constitute the entire agreement between the parties with respect to the subject matter hereof. Our failure to insist upon or enforce strict performance of any term shall not be construed as a waiver. If any part of these Terms is determined in arbitration or by a court of competent jurisdiction to be invalid or unenforceable, that part shall be limited or eliminated to the minimum extent necessary so that the remainder remains fully enforceable and legally binding. These Terms are governed and controlled by the laws of the State of South Carolina without reference to applicable choice-of-law provisions. You agree to the sole and exclusive jurisdiction and venue of arbitration occurring in Spartanburg County, South Carolina USA in the event of any dispute of any kind arising from or relating to these Terms, the Privacy Policy, your use of the Site, or the Service.
